Respecting artists and copyright holders is something we take seriously. Here’s everything you need to know about how we ensure a respectful and compliant environment for all members of the Pigment Gallery.
When you join the Gallery, you agree to Pixite's Terms of Use:
It is the user’s responsibility to ensure that there are no restrictions based on third party rights for any images or other content shared by such user within “Pigment Gallery” or “Assembly Gallery”... By using “Pigment Gallery” and/or “Assembly Gallery” you represent and warrant that your use will be consistent with all applicable laws including, without limitation, copyright, privacy and publicity laws, and that you will not infringe or violate the rights of any other party. You agree to hold harmless, defend and indemnify Pixite from any breach of the foregoing obligations by you. To the extent applicable, Assembly users may credit third party rights through the image description function and Pigment users may do so using the attribution feature (pending update of ToU).
In plain language this means, when you color artwork that is not your own creation, you are responsible for making sure that you have the legal right (a.k.a license) to publish it in our Pigment Gallery. This should never be assumed.
Additionally, our Gallery Community rules state:
If you suspect a Gallery member of improper use, keep in mind that users already signed an agreement that their imports do not infringe or violate the rights of any other party. They are not obligated by terms of use to provide any further claims or proof. If you are the original artist of a work being misused in the Gallery, please use our DMCA form.
Ultimately, only the copyright holder has standing in reporting copyright infractions. Our members have agreed to not infringe upon the copyrights of other individuals. Pixite provides an easy way to credit or attribute the work you post and an easy way for copyright holders to report violations to us via DCMA forms.
When we see copyright violations in the Gallery, we remove those posts. While it’s impossible to monitor every post due to the sheer volume, we take immediate action when the occasion arises. Our moderators always reach out to everyone identified as having violated our copyright policy with information that will help them avoid similar problems in the future.
